Authorship in Legal Discourse essay. The authorship of essays on color a particular piece of writing is the identity of the general person who made it. Nowadays the question of essays psychology authorship is general job resume, really sharp. When the case touches upon the legal discourse, lots of disputes appear. The correlation between authorship and text interested scientists continued all over the last century and continues until today. Psychology. The most long lasting connection in this regard was coming from the literary text and different philologies. On the other hand, as the Internet develops extremely swiftly, the questions of unique links becomes even sharper than the one with literary works. Life. If describing authorship abstractedly, it involves the controlled collection or creation of media and the association and outline of that media in a larger arrangement. However, authorship means more than just selection and essays, creation; it is a multifarious construct incorporating concepts of uniqueness, intertextuality and ascription. Authorship can be seen as the mission of making alternatives and selections, relating to the construction and content of media elements within the limitations of a particular standard. Plagiarism has always been the best example of legal contest in authorship.

It is also a good example of how both social and legal norms are used to nonplagiarized dampen or restrain behavior, surrounding authorship. It is clear that in order to avert potential stigma, an author must work within legal laws and social values; it is also important to operate in accordance with a particular community or culture (Koppel, Messeri Shler). Legal constraints represent an influential part of psychology authorship, in terms of what is not or is lawfully acceptable in resume a society or legal jurisdiction (Lessig). The constraint is compulsory, using castigation as a violation result or by encoding the legal constraint into the software to passively avoid mistreatment. In most countries, the primary mechanism for protecting authors’ property rights is copyright law. Authors must create it in accordance with the law and pay attention to the fact that their use of appropriated material is covered under the essays fair use clause of their copyright act (United States Copyright Act ). Many aspects of nonplagiarized essays fast copyright laws are codified and standardized in the international intellectual property treaty (the Berne Convention), and essays on color, most nations of the world have now signed it. Copyright law is principally used to protect economic interests, but in ut transfer jurisdictions of some countries the concept of authorial moral rights ( droit moral ) is embedded in the legal codes. Moral rights are concerned with protecting the self-respect and autonomy of authors and contain the right of disclosure (when to openly disseminate a work), the on color psychology right of integrity (prohibition of the falsification of an author’s expression), and covering, the right of attribution (being accepted as the essays on color psychology author) (Kwall).

Moral rights tend to reflect the notion of authorship. They protect the human spirit, contained in an author’s creations. If there are no legal aspects to protect moral rights, other environmental constraints, such as community and social norms can take part in the intervention of such concerns. Unfortunately, copyright law is not always observed, especially on the Internet. The process of reverse vending designing in new media consists of selection from different menus of software packages, media assets databases, etc. In the same way, a user is psychology, made to feel like an ut transfer e, artist by allowing him/her to quickly create a professional work by selecting from a lot of menus. If to take any Search Engine, it is easy to see that, for example, Google’s relationship with links over the last 15 years has changed. There is a beginning of essays psychology suffering from general, trust issues that have been discussed for essays over a decade of the general job resume SEO community, manipulating link graph. In software-driven production environments, all the quotations come not from memories of the creators’ of what they saw, read, or heard before, but also directly from these search engines and media assets’ databases, as well as lots of other reasons that in case of the World Wide Web are only a click away.

Fortunately, the owners of on color social networks and other sites make all possible attempts for pages’ verification, blogs’ authorship attribution, etc. Methods of authorship attribution are assumption based; the assumption is that people have small set of candidate authors. As or law enforcement, however the assumption is violated quite often. There might be no closed set of expectations at all or it might be a closed set, including a lot of suspects. This problem is quite straightforward (Kopper, Messeri Shler). Ut Transfer Essay E. To define correctly the fact of authorship it is important to pay attention to the following stylistic features: - Function words: These words are the ancestors of all stylistic features of authorship; - Syntax: Undoubtedly, different authors use syntax differently, that is why in legal questions and essays on color psychology, analyses this feature can help to define the authorship of this or that work; - Syntemic Functional Linguistics trees: These are glorified parts of speech, specific kinds of conjunctions; - Morphology: The frequent usage of different grammar suffixes and prefixes that can sometimes be useful clues for authorship; - Complexity measures: This feature historically happened to be explored as possible markers of authorship; - Idiosyncraisies: Such features as exotic syntax, neologisms, word construction, etc. tend to jobs be the identifiers of essays on color anonymous authors (Kopper, Messeri Shler). There are also continuous contests about the fact which works should be categorized as those which have unique authorship. Letters. In most cases these are tape recordings, computer software, sheet music, records, movies, laser disk games, designs, video disk productions, magazines, cartoons, books and poems.

At the same time, book titles, songs and stories; short phrases and essays psychology, slogans; printed forms; tables and lists taken from public documents; complications of facts are not qualified as original works of authorship. The law considers these items as short or lacking originality to qualify for protections of copyright. These items, especially slogans, make a lot of contest in legal discourse. The field of publicity attracts too many people who think their creations are unique. In pursuit of money and fame making these “creators” can just remake famous poems or songs’ lyrics.

Such an unfair competition often engenders judicial pleadings which, in their turn, can have very deplorable results. In particular, there is a concept of authorship’s satisfaction constraint and it is important to provide an understanding of how environmental constraints affect four main components of authorship mentioned before: attribution, authority, originality, and breton, intertextuality. Through the last decade social protections against deceptive authorial attributions were not clearly defined, but they continued their existence under the on color rubric of trademark law. Ut Transfer Essay. Along with copyright law there appeared trademark law as a part of the broader law of essays on color psychology unfair competition (Diakopoulos, Kurt Medynskiy). The very concept of authorship seems to be grounded in the 18 th century concept of an author as a unique creative genius and the sole owner of the rights to his/her intellectual product. The Enlightenment era contributed to the conceptualization of authorship as a purely individualized phenomenon that should be evaluated proceeding from the concept of ‘originality’ that became especially prominent in the period of the 19th century “Romantic literary criticism” (qtd. in essay greatest dream Jaszi 30).

According to Woodmansee, the on color emergence of modern copyright concept was necessarily connected with the nascent professional writers’ social group that was inherently interested in “redefining the nature of writing”, thus leading to the rise of the proprietary copyright doctrine (Woodmansee 425). Furthermore, the establishment of the permanent copyright legal doctrines may be connected more with the publishers’ campaigns to secure the continuous exercise of the legal rights to the respective literary creations (Rose 51). In France, in particular, the transformation of the author and publisher’s copyright from the royal privilege accorded to specific publishers into the socially acknowledged ‘moral right’ took place at the end of the dream life Enlightenment era but was actually cemented by the Napoleonic Code (Saunders 75-106). However, in Great Britain, these efforts were originally doomed to failure, and it was not earlier than the 19th century when the installation of perpetual copyright law as the key concept of the Common Law authorship provisions eventually took place (Jaszi). In the USA, the development of the copyright law from the very outset became one of the important preoccupations of the essays Federal government. Saunders notes that the Founding Fathers exerted significant efforts to essay assist in the formation of the modern concept of the sole authorship-based copyright law. On Color. For instance, the breton provision of Article 1, Section 8 of the U.S.

Constitution specifically provides for the Congress “to promote the Progress of Science and Useful Arts, by securing for limited times to Authors and Investors the exclusive Right to their respective Writings and Discoveries” (U.S. Essays Psychology. Constitution art. I, sec. Job Resume. 8). Psychology. In so doing, the U.S. Constitution laid the vending foundations for the development and entrenchment of the specifically modern interpretation of the copyright law as conducive to the facilitation of on color psychology both individual and societal progress.

It may be easily understood that this provision proceeded from the assumption of the existence of the sole author or discoverer who was assumed to exercise his unique talents for the betterment or enlightenment of the whole mankind. Breton. Such opinion was exemplified by the 1834 Supreme Court ruling in Wheaton v. On Color. Peters case: The great principle on which the author’s right rests, is, that is the breton fruit or production of his own labour, and which may, by the labour of the faculties of mind, establish a right of essays on color property, as well as by the faculties of the bodies It is founded upon ut transfer e the soundest principles of justice, equity and public policy. ( Wheaton v. On Color Psychology. Peters 669-670) Such affirmation of the right of perpetual copyright would sit especially well with the Lockean concept of natural rights that was propounded by the majority of the early American legal and political thinkers (Saunders 152). However, the use of the sole proprietorship notion of the copyright law may be taken as limiting the capacity of both lawmakers and the other legal actors to deal with the problem of collective creative work, while imposing significant restrictions upon the proliferation of the work in question. From the beginning of the 20 th century to greatest dream its end, the relationship between creators and law was as much an effort to negotiate the ways they would be recognized for their work and whether or how they would be considered by this or that public, as it was about whether they would own to copyright in their work. On Color Psychology. A copyright was usually managed, if not owned by others. However, in many cases a reputation was something that seemed more important. Yet it became difficult to control the proportion to vending the value of controlling it. As described by Posner, “the concept of personality is central to the copyright laws” (42). Subsequently, the act of copying may be deemed “impairing or appropriating personality” of a maker of the respective intellectual product (Posner 42).

As it was already mentioned, the sole proprietorship concept of copyright law leads to increasingly narrow conceptualization of the relationship between the “copyrighted entity” and “collective creativity” (Zemer 1). The modern concept of the copyright would thus ignore the problem of social nature of the creative process. This may strike one as especially strange, for essays the very production of the resume breton artistic or literary work that is then considered to constitute an object of exclusive authorial ownership “”depends on essays on color, the consumption of cultural and social properties” that enable the author him/herself to engage in creative activity (Zemer 2). While this critique of the concept of the unique authorial capacity to hold right to the ‘original’ product may have direct relevance from the greatest viewpoint of essays post-modernist cultural criticism, it may be questioned as having no relation to the purely legal issues of e copyright law. However, Rahmatian attempted to on color review and analyze some intricacies of the copyright law that would make the concept of essay e authorship problematic from the juridical perspective.

In particular, he turns the reader’s attention to the problem of divergence between the authorship rights of the person employed at essays psychology, the corporation or another legal entity that would be legally entitled to copyrights for all works produced by this person (Rahmatian 172). This very formulation would make the authorship concept practically redundant from the viewpoint of the U.S. copyright law. Essay E. In Rahmatian’s opinion, the “vague” definition of an author in the American legislation “does not expressly stand against the juridical person”, as might be evident from the example of computer-generated copyrighted products (Rahmatian 172). The author observes that in this case, “an author has to be defined artificially by law,” (172) leading to the situation controversial for those who would try to associate the copyright law with the notion of guaranteeing one’s creativity against psychology, plagiarism or other usurpation. The same situation would arise if the issue of entrepreneurial works might be considered. Here the essay investors are enabled to essays psychology receive the copyright law’s benefits by “virtue ofinvestment,” alienating the authorship rights from the makers or devisers of the general job resume actual products. The “producer of sound recordings, the essays on color maker of ut transfer e broadcasts andthe publisher” are legally considered to be ‘authors’, even though technically they are none (Rahmatian 173). As such state of affairs is essays, increasingly prevalent in contemporary societies, one can no longer speak with certainty of the reverse vending thesis positive role of the essays on color psychology copyright law in safeguarding “the author’s right”, as it was expressed under Wheaton v. Peters legal doctrine. To summarize, the main bulk of modern copyright law bears no causal relationship with the need to guarantee the author’s right to the product of one’s labor, as it would be under the Lockean doctrine of intellectual property established in the 19th century USA. The main beneficiaries of the copyright laws are thus not the direct authors themselves but the copyright-holding legal entities that are then considered ‘authors’ in life the legal discourse. Such situation necessarily leads to the erosion of the on color psychology original idea of authentic and original authorial works that motivated the lawmakers in devising the greatest dream life copyright law in the era of Enlightenment and the American Revolution.

Thus, the actual law would seem to diverge from the original intents of its creators. Furthermore, the very idea of ‘author’ as a unique creator of the work of on color psychology art or literature would bear no relationship to the empirical reality of the creative activity, for the generation of creative product in general strongly depends on the socio-cultural framework within which the ‘author’ would carry out his/her working process. Hence, the legal idea of ‘authorship’ would appear to be ahistorical and unrelated to the corresponding social reality.

Color Psychology Essay - 1152 Words - brightkite com

On Whimwhams and Wild Whats: Amy Leach#8217;s Things That Are. As longtime readers of essays on color Ekostories know, I harbour a great fondness for several storytellers: Hayao Miyazaki, for his meticulous world-building and greatest life philosophy; Michael Pollan, with his blend of on color Thoreau-tinged romanticism and candid introspection; John Steinbeck, for essays fast his warmth and compassion toward fellow beings; and of course, Ursula Le Guin, in her treatment of her craft as an ethical endeavour. Their writings and worldviews have in turn shaped my worldview and writing, and for essays on color that I hold them in high esteem. Leach has made her way into that select group. At once frivolous and profound, cosmic and intimate, silly and covering letters thought-provoking, each piece of (very) creative non-fiction in her debut collection are lyrical gems, conveying the wonders of world and universe through a sheer exuberance for life and language.

Things That Are comprise twenty-six essays on on color, subjects ranging from swinging caterpillars and fainting goats to nonplagiarized fast pea plants traversing Norse abysses and potential planets full of essays on color psychology hypothetical beans. Some pieces, like The Trappists , are short and succinct, while others like, The Safari (my personal favourite), leverage their length and unfurl into a revelatory read. One could classify Things That Are as nature writing, for many pieces explore natural history with a naturalist’s penchant for detail, but that seems too limited a category. Dream? Leach’s essays are as much fairy tales and nursery rhymes as they are Attenborough documentaries and Sagan space odyssey. They are never dull, filled with bizarre comparisons and essays psychology so much general silliness that the punctuated poignant moments come slant and hit hard. Thesis? I don’t quite know what Things That Are is; I only know there’s nothing like it. Psychology? The most striking thing about job resume Things That Are is the sense of playfulness that permeates every page. Essays Psychology? Leach employs a host of literary techniques, from rhyme to repetition to general job resume onomatopoeia, to make her pieces a joy to read, especially aloud. Essays On Color? For example, I can’t help but grin at her gleeful distillation of a panda’s personality in Radical Bears in the Forest Delicious : What does the [panda] do all day who is not engaged in society, its duties and pleasures and ferments?

There may be some wedging in trees, some gazing into the mist, some fiddle-faddle… Sometimes, trotting pigeon-toed across a hillside, he trips, then rolls, because he is round; having enjoyed that, he climbs back up and rolls back down. Leach#8217;s work is akin to children stories that revel in the luscious sounds of language, filled with words and images that tap directly into the imagination. Language is not merely a means of delivering ideas, but is itself an instrumental part of the message. The flourishes in her prose directly represent the phenomena that exist in world and universe. Fast? Both exist beyond notions of utility and purpose, but have intrinsic value and beauty in and of themselves. On Color Psychology? Yet Leach’s sing-song style is not devoid of nonplagiarized essays substance; it rests upon essays a wealth of essays fast fantastic facts ranging from the types and numbers of essays on color eyes on a box jellyfish to the rowing habits of nonplagiarized essays whirligigs. What I appreciate is psychology that Leach understands that while facts are true and covering jobs strange, they alone do not provide context and essays lasting connection to most readers. Instead, she blends them with her lyrical sensibilities to forge a sounder foundation, one rooted in both wonder and understanding, designed to enchant and inspire.

Sometimes that means inventing words like “vasty” and “mouldywarp” and concepts like “radish ministers” and letters jobs “molecule trustees” to make things more digestible (and fun to read). Other times it means leaping fearlessly across the void, connecting inconsequential insignificances to a broader and richer understanding of the world. For me, the most powerful portions of Leach’s essays come in the form of those leaps. Many a time, I would be reading along, relishing in her facts and fancies. But then a passage, a sentence, would escort me out into on color psychology the comfortable confines of an ordinary matter into grander soul-stirring revelations. In Goats and Bygone Goats , she takes me from the bleat of goats to ancient starshine to memory in a few short sentences: #8220;It is too bad that sound waves decay… The world, full of general job resume past sounds, would be like the sky, full of past light. The world would be like the mind, for which there is no once.#8221; In Love , she connects the red of Amanranthus flowers to the essence of lost love: #8220;Only love can bleed forever; only love has endless blood. Only love’s slender drooping tassels can bleed yet grow stronger, bleed yet grow brighter; redder, redder, never spent, never phantasmal-gray…But when it suffers a terrible wound, love seems able neither to heal-to grow substitute tissue over its damage nor to run dry.#8221; Or pea plants to the risks and rewards of vulnerability in Pea Madness : #8220;Plants cannot stay safe.

Desire for light spools from psychology, grass out of the ground; desire for a visitor spools red ruffles out of twigs. Covering? Desire makes plants very brave, so they can find what they desire; and very tender, so they can feel what they find… Those who are feeling their way into the Ginnungagap must be able to feel, which means able to freckle, and essays on color psychology fringe, and covering letters soften, and tilt. And if they can tilt they can fall; which is a different design from that of the ticking hearts of crystal-quartz.#8221; Or capturing the intensity of nostalgia with a scene of on color nature in The Safari : #8220;And then one of your little days, like a kingfisher, will fly over the water, diving down beneath opaque golden surface of your mind, where swim your earliest, submarine memories. What is caught is a tiny primeval memory that should mean nothing, a throwaway. Yet when pulled out of the water, gripped in a bird beak, lading the air and throwing flashing grapefruit-colored water drops from its glittering, tiny perishing silver self, this forgotten, underwater matter will suddenly mean all the nadja breton world to you the long lost glittering hour that means more than age, more than logic, more than lore.#8221; Beyond fancy wordplay and strange facts, these passages showcase the on color psychology power a great essayist can wield as he/she delves within the self and expand out into the world. Ekostories explores stories that connect nature, culture, and identity. Letters Jobs? Things That Are does this on every page, in every exquisitely wrought paragraph, with every fantastic description of migrating warblers, exploding sea cucumbers, ravenous turkey tails, temperamental stars, and lonely sirens who sing to the delight of dogs. I read it in awe. #8220;We had heard that bad things were in store for essays nature, the jobs way the oceans are overfished and the skies fouled, but in my city people are not so horrifiable: we’d seen movies of the future, when the Earth is finished being ruined humans wheezing out some last haggard weeks in cement tenements and yet to us these conditions didn’t look so strange. We were hard to horrify, living already if nature were gone…#8221; The last essay in essays psychology the collection, The Round-Earth Affair , is arguably the most message-driven piece.

Yet it is still a joy to read. Here Leach speaks to those who have become jaded to the fate of our damaged world, and those who attempt to evoke guilt and fear to bring about change: #8220;And so it was useless for anyone to try and sign us on with the general ranks of the on color environmentally panicked, or the ut transfer essay e environmentally conscientious, or even the environmentally uneasy. We were resigned to essays on color psychology losing Planet Earth, whose silence, whose spaciousness, whose Newfoundland, whose whales, were as foreign to us as Planet Huffenpuff’s over in the next galaxy. Imaginary, or very far away, was how we saw “Earth,” the nonplagiarized essays fast though of whose demise brought some folks to weepy shrieks. But while resigned people can be infuriatingly unresponsive to shrieks, they are, in some ways, very easy to enchant: when you expect to lunch on roaches and granite, bread delights you.#8221; It is this approach of delight and enchantment that Leach constantly employs throughout Things That Are . In the last paragraph of Donkey Derby, the first essay of the essays collection, Leach asks us to embark on that journey towards rekindling our connection with the world: #8220;Tonight, on this the latest antecedent to tomorrow, it is starry out and I am not in a conquering mood. Come and jobs miss the boat with me. Come and play some guessing games. We’ll read aloud the illegible electric green script of the essays on color northern lights; we’ll speculate about which star in the next ten thousand years is join got go supernova. Reverse Vending? Then we’ll listen to a recording of essays psychology “Epistrophy”. I’ll wager on his left thumb, you take whichever finger you want, and with the covering mad currency we collect from psychology, each other I’ll buy you rain, you buy me snow, and we’ll go in together for sunshine for the grass and the clover and the delicious prickly thistles.#8221; This collection of ut transfer wonderful, beautiful essays is a must-read. I’ll leave this week with a video of Leach reading a few of her pieces.

Ever since Newark Public Schools (NPS) Superintendent Cami Anderson's December announcement of her district's turnaround program, One Newark, parents and teachers have faced growing uncertainty about the future of their district.

The program proposes to turn Newark Public School buildings over to essays charter management organizations, combine several high school campuses and implement an open enrollment program to allow for district-wide choice. As NPS prepares to shed a third of its 38,000 students over nonplagiarized the next three years, the causes of its decline have been called into question. Unlike many centers of post-industrial depression, the essays on color psychology, population in Newark actually grew during the last census. The district claims that parents are the dream life, force behind its declining enrollment numbers, citing the all-powerful explanation of choice, but the psychology, Newark Teachers Union (NTU), together with a New Jersey state senator, has offered an alternative interpretation. Greatest Life! Rather than market imperatives necessitating layoffs and downsizing, they allege that district policy is shifting larger numbers of students into essays on color psychology charter schools, penalizing public schools teachers for the demographics of vending thesis, their students, and, according to a congressional investigation, preparing public assets for sale to for-profit companies. We got two different things going on in Newark, said Bruce Baker, a professor at Rutgers' Graduate School of Education, in reference to the expansion of charter seats under Superintendent Anderson and the projected enrollment decline in the district. They are coupled, but its a little unclear how they're coupled.

Beginning this year with an attempt to disregard seniority rights in essays, district staffing decisions and a plan to replace 700 existing teachers, a total number reported by essay e, NTU president Joseph Del Grosso, the projected enrollment decline has put the district on a three-year downsizing program. According to Vanessa Rodriguez, NPS chief talent officer, the reduction is the result of public choice. Families are voting with their feet in psychology, search of general job resume, excellent schools, she wrote in on color psychology, a statement emailed to Truthout. When they choose non-NPS options, money follows the student, and with diminished funds, NPS cannot sustain its current number of employees. But resource allocation isn't up to the families of Newark's school children. NPS has been under state control since 1995, and the power to authorize charters comes directly from Trenton, the state capital, rather than from parents' referendums. Greatest Life! This complicates the story of on color, parental choice that has been told about general, Newark's rapidly changing education system. On Color! As the ut transfer, Newark Star-Ledger put it in an editorial, declining enrollment has accelerated lately as Newark families flock to charter schools. Essays Psychology! [As a result] Anderson, like any rational manager, must close schools and cut jobs to right-size the district.

But this acceleration seems to essay be more a product of the Christie administration, which channels philanthropy dollars into charter schools, than it does a matter of fair competition. Essays On Color! In fact, the charter schools it authorizes end up competing for parents in the very district under state control. [Charter schools] are paying teachers 20 to 30 percent more to reverse allocate approximately 20 to essays on color psychology 30 percent more time, says Baker, explaining how longer school years and wrap-around services give privately managed schools a competitive edge. They're doing something that kind of just makes sense. Because turnover is higher in charter schools, says Baker, teachers there do not accumulate experience and the higher salaries that come with it. Nonplagiarized! As a result, charters can offer more services in addition to better pay for teachers - all at a lower cost to taxpayers as philanthropy networks fill the gaps. But for an old guard of teacher-professionals, for whom teaching is a skilled career, rather than a temporary resume builder, the comparison is unfair. Who champions our cause? asks NTU president Joseph Del Grosso. Essays Psychology! We don't have anyone talking about the good public schools that we have . . . that are competitive with, and even better than, some of the suburban schools. But that's not what [the superintendent] is breton, advertising. Rather than the backbone of essays on color, these public schools, district documentation points out that Staff make up 95 percent of school-based budgets, and that Because NPS will lose approximately 30 percent more of its students, unfortunately, we must reduce staff by a similar factor.

What we don't know is whether some of that projected enrollment decline is from reconstituting some of [Anderson's] own schools as being under charter governance, said Baker. Covering Letters! That would be like a forced enrollment decline. That would seem to on color psychology be part of the story, he added, before noting that district language separates the two policies. Logistically they got to be coupled, but no one's being clear as to exactly how. Matthew Frankel, director of communications for job resume, Newark Public Schools, said that none of the charter expansions under the essays, One Newark plan are newly approved seats. E! Charter schools were pre-approved by psychology, the state, he said. Indeed, the many pages of public documentation for the One Newark plan clearly state that all of the additional charter seats were approved in prior years by the Christie administration. The documents insist the plan redirects charter growth to e those neighborhoods most in essays, need of - and demanding - innovation. But whether pre-approved or new, it is state policy that seems to be directing students in Newark into privately managed schools. As the district prepares to machine shed staff, the superintendent attempted during the last week of February to get permission from Christopher Cerf, state education commissioner, to make performance-based layoffs that consider quality alongside years of service, as one district document put it. It was the on color psychology, commissioner's last week, and the request would have been one of his final acts at the head of the state Education Department.

But the policy met scrutiny on two levels. The first was from the union, which saw the move as an e attempt to essays on color circumvent negotiated contract language that protects the professional autonomy of teachers. Joseph Del Grosso described the equivalency requests - the name the district has given the policy - as a waiver that would provide for dismissing people without due process. In its own explanation for the requests, the district made clear that the purpose of the policy was to allow staffing decisions to be made on the basis of ut transfer essay, newly implemented teacher evaluations, rather than the contractually mandated seniority requirements. We negotiated peer review, said Del Grosso, referring to the employment contract the union signed with the on color, district at the end of 2012. Covering Letters Jobs! In addition to essays on color psychology including teachers' input in greatest dream, their coworkers' performance evaluations, the union president explained, the contract was intended to provide for an appeals process in case disagreements arose. In the wake of the 2012 TEACHNJ Act, which allows superintendents to essays on color dismiss at will teachers rated ineffective, these protections were especially important to the union. Those things are primarily why we signed on to this contract, he said, adding that they are also the things that haven't been implemented. A document supplied by the district noted that six peer oversight committee meetings with NTU representatives were convened last year to discuss the peer validation and teacher evaluation processes. The second level on which policy was scrutinized is the methodology of the ut transfer essay e, teacher evaluations themselves: There's not any great deal of precision in the state's teacher evaluations, said Baker, nor do they make available the data on the citywide teacher ratings.

According to Baker, his and others' research has found that the on color psychology, methods used to thesis determine one of New Jersey's primary measures of student progress, student growth percentiles, are particularly bad - that they merely reflect the demography of the students served because they don't try to essays control for anything but prior scores. He added, As a result, in New Jersey, the schools with more low-income kids, more nonproficient special education kids and so on have significantly lower growth percentiles, before clarifying that it was unclear what weight the student growth percentiles played in Newark's teacher evaluations. Documentation provided by the district did not state how teachers' annual evaluations were determined beyond including observations from an outside, independent, experienced organization based on a Framework for Effective Teaching. When asked, the district did not provide the essays fast, name of the independent evaluators. As part of on color psychology, her bid for the equivalency requests, Superintendent Anderson was expected to appear before a monthly School Advisory Board meeting last Tuesday night to discuss the covering letters jobs, policy with the public.

Instead, the district sent a letter announcing that neither the Superintendent nor NPS staff would attend that night's or any future School Advisory Board meetings until the on color psychology, board could 'commit to ensuring a space conducive to open dialogue with the community', writing that the dysfunction displayed within this forum sets a bad example for our children, and it's no longer a place where meaningful interaction and dialogue occurs between NPS and the public. This shocked many. Future announcements and policy changes will be recorded and broadcast, rather than open to public comment as they had been up to ut transfer essay that point. The cancellation of the forum also brought into question the education commissioner's authority to grant the equivalency request, as the public meetings had been thought by Del Grosso to be part of a legal process for having such waivers approved. While the Office of the on color, Education Commissioner's' website states that The Commissioner's decisions have the force of law, New Jersey State Senator Ronald Rice disagreed.

Any granting of equivalency waivers to grant dismissal based on performances in addition to seniority may be violating both the spirit and intent of the statutes [governing seniority rights in employment], he said. Nonplagiarized Essays! Del Grosso was less sure: It's a state-run district; anything could happen. Commissioner Cerf's office did not respond for comment, and by February 28, his last day, the requests had not been granted. But the combination of increased charter management in on color psychology, Newark and arbitrary teacher evaluations for district teachers has caught the ire of more than just the NTU. Senator Rice said that he is opening an investigation into district policy and requesting subpoena power, holding a press conference February 28th to make public the allegations he will be looking into. [Anderson]'s been depopulating [the district schools], just like they did in New Orleans, he said before the conference, alleging that the idea [behind district and ut transfer e, state policy] is to take the public assets, buildings, and to on color sell these buildings to for-profit corporations. He noted that his investigation will look into reverse the sale of one school, the 18th Avenue School, which was sold by the district at half of its appraised price to a for-profit company that shares board members with the charter operator TEAM Academy. A source close to the union alleges that the purchaser - Pink Hulahoop LLC - leveraged the on color psychology, transaction with state tax credits and breton, plans to essays on color rent out the building to a charter school.

Another sore point for ut transfer essay, the NTU has been the increased recruitment of staff by the Teach for essays psychology, America - Newark program during a period of district downsizing. Nadja Breton! Funded by the Walton Family Foundation, Teach for psychology, America - Newark proposes to support the thesis, recruitment, training and support of nearly 370 Newark area teachers over the next two years. Frankel noted that about 40 teachers in essays, NPS are currently supplied by Teach for America, before directing Truthout to this clarification of the Foundation's future involvement in nonplagiarized, Newark, written by the executive director of Teach for America New Jersey. The director asserted that the number of psychology, Teach for America openings for the coming year will be nowhere near 300 as claimed. NPS Superintendent Anderson is an alumna of the Teach for America program and a fellow at the Pahara-Aspen Institute, which, as educator Diane Ravitch has noted, is a partner of the Broad Foundation. Through its administrative accreditation program, the reverse vending thesis, Broad Academy, the foundation has trained the psychology, superintendents of a number of troubled school districts, including Philadelphia and Chicago. Called for comment about the Teach for America - Newark program, Walton Family Foundation communications director Daphne Moore did not answer the phone. The Pahara-Aspen institute likewise did not respond to job resume repeated phone calls. While NPS denies that foundations have any influence over policy, Senator Rice disagrees, alleging that state and district administrators are part of a privatization movement. When asked why he thought State Education Commissioner Cerf - to whom Anderson appealed for expanded layoff powers - was leaving office Friday, the Senator said it was to essays return to his old boss.

Cerf is on the board of the TEAM Academy, a charter operator implicated in Rice's investigation, and worked with education consulting firms in New York before entering public service. His job was to get people like Cami [Anderson] . . . to take over school districts, he added. He's pretty much implemented and laid the foundation for some successes, if you will, in terms of accomplishing his mission. Job Resume! People look at on color psychology bridge-gate, but they better look at this Cami-gate stuff and resume nadja, this Cerf-gate stuff, because it seems to be very serious.
